Since she took the ride, always tell the insurance companies you have back problems until they make you whole. Usually they can't wait to settle.

did DD call the other guy's insurance to get a claim going? you can't trust that the other person called it in to the insurance. & it's a good precaution if there are any medical bills since some medical insurances may have a clause/exclusion for accidents caused by another party. i work with insurance/benefits so i get to see a lot of different plans & this is in all the ones i work with. med insurance will pay out 2nd to those claims paid by the car insurance if that's the case. if you have to take them to court for any kind of settlement & if the medical claims got paid from the med insurance she may have to pay those back.
