Is the four foot fence just wire 4x4 or 2x4" that you could put one line of fence and another one up on top of it? You could get your 8 feet of height that way. If you have plenty of fencing to work with you could put one row of fencing out farther, too. The hot wire sounds good, tho.

Lucky the tree is in front yard. I have gladys kravitz ( neighbor from bewitch) across the street. If she thinks its a eyesore she will put a unsigned note in my mailbox. 8 foot high fence would kill the old lady.

Definitely try the repellents NYboy.
Although fencing is also a good idea from the standpoint of keeping bucks from rubbing the bark off during the rut.

I make a repellent that works great for me. We have tons of deer in this area and last year they started to eat all my day lilies, new cherry tree, hostas and many other flowers. We have so many deer you can see them walking down the street at night. I mixed up some tabasco sauce, an egg and a few drops of dish soap with some hot water in a spray bottle. I got the hottest tabasco I could find. I sprayed the plants every few days or after it rained at first. After the first week the deer stopped eating my plants and I started to spray the plants about once a week. I would see a nibble here or there but even that stopped. I haven't sprayed yet this year, but will soon. I know the deer have through the yard but only a nibble here and there so far. I walk the yard daily and look at all my plants so spraying then didn't take any extra time. Not sure how well it would work for a larger garden/yard. But it works for me.
