I go back and fourth with this. One part of me thinks she was a very brave woman to stand up to police. The other part of me thinks if you where driving and drinking you give up your rights. There was a accident only reason for blood would be to check for drugs or alcohol

You do not give up your rights when you are driving and drinking but you subject yourself to possible punishment for breaking the law. Every scumbag arrested has to be read their rights. People tend to forget that a basic tenet of our law is "Innocent until proven guilty". No matter how obvious guilt may be to the person performing the arrest that proof has to come in a court of law. Until they are proven guilty in a court of law they have their rights.

Whether she wanted to or not she was just following the hospitals policy, the man was unconscious and couldn't give his consent.

The cops should have went to a judge and got the warrant within an hour or less. We are a nation of laws that need to be followed whether you like them or not. This cop should have known this doesn't he watch law and order lol.

The truck driver was hit by someone fleeing from police. He was a victim. They were likely trying to cover up for the fact that the suspect caused grave harm to the truck driver. She likely would have been fired for caving into her personal fear and breaking the law by obeying the police. She his braver than I.

Yes. She did the right thing. the Law states the police re required to have a warrant to seize a blood draw. He was unconscious and could not give consent.

She had no choice. Police are not trained. Like a lot of small town police,not used to doing things legal-I know Salt Lake City not a small town.

She was right. The police were wrong. That said, the police have some tough job. I sure wouldn't want it and I am glad they are on the job.

She did exactly what she should have, otherwise she would have been breaking the law and open to a lawsuit. I see that cop is now on Administrative Leave, so now he is sitting at home and still getting paid. That is par for the course with police departments and it SMELLS! Why should taxpayers have to pay that jerk, or any other bad cop, until the case is settled? Especially with the evidence that the video provides!
